    iPhone 4s Owners Accuse Apple of Financially Benefiting from iOS 9 Slowing Their Devices

    Android users are often left displeased thanks to a lack of consistent updates and then there is iOS where users can sometimes find the updates a little too much for their devices. iPhone 4s owners claim that iOS 9 update made their phones “significantly” slow and “interfered with the normal usage of the device.” A hundred iPhone 4s users have filed a class action lawsuit against Apple seeking over $5 million in damages for deceptive trade practices and false advertising.

    Apple financially benefits from slowed-down iPhone 4s, claims the lawsuit:

    Plaintiffs claim that Apple failed to notify the owners of older iOS devices about the new software update potentially slowing the performance of these devices. Plaintiff Chaim Lerman said that users had only two choices of either putting up with a “slow and buggy” device, or buying a new iPhone. He further says that Apple benefits from this as users often have no choice but to spend hundreds of dollars on a new iPhone, due to the increased learning curve associated with a new platform and more importantly, to save the investment in Apple’s app ecosystem.
    When iPhone 4s owners are faced with the dilemma of continuing to use a slow, buggy phone or spend hundreds to buy a new phone, Apple often benefits because consumers will often buy a new iPhone to keep their investment in the App ecosystem.

    Furthermore, iPhone owners will buy a newer iPhone when faced with the choice because it is familiar and they can easily transfer their information, media, contacts, and apps without a major disruption in usage. There is no learning curve and no delays and trouble that accompany new information input. Thus Apple stands to benefit financially when older iPhones are slowed down and owners are forced to purchase a new phone.
    The lawsuit claims that Apple was well aware of iOS 9’s impact on iPhone 4s functionality through “internal testing and/or through other means,” but it chose not to warn the users and broadly advertised the new OS for its positive features such as enhanced security, faster performance and longer battery life.
    As noted by the folks at AppleInsider, every new iOS update focuses on taking the best out of the latest hardware. iPhone 6s and 6s Plus, on which iOS 9 is primarily focused on, feature a significantly improved hardware when compared to iPhone 4s, obviously creating performance issues on the older hardware. While many of the users are well aware of the negative impacts of latest OS updates on the legacy devices, not everyone is as technically adept. The case argues that Apple has a responsibility to protect those consumers who aren’t aware of these impacts, instead of pushing them to invest in new hardware or deal with buggy devices.

    Apple forced to pay back tax to Italy



    Will help with its debt crisis
    The Italian government has told Apple that it is to stop mucking about and pay back the $348m it did not pay in the broke country.

    The demand follows an investigation into tax fraud allegations where Apple failed to pay €880m in tax between 2008 and 2013. Apple finally settled with the Milan prosecutors to pay about half the sum.
    Surprisingly Apple has not commented on the case and the Tame Apple press failed to mention much about it. But Jobs’ Mob has previously denied attempting to escape paying tax owed on profits made around the world.
    Apple Italia tried to avoid paying tax by having its headquarters in Ireland which has one of the lowest levels of corporation tax in the EU. Ireland taxes corporate earnings from normal business activities at a rate of 12.5 per cent compared with 27.5 per cent in Italy.
    The Fruity cargo cult made a billion euro in Italy between 2008 and 2013 but for some reason only paid 30 million euro. Even in Italy, that was taking the Nintendo a bit.
    Jobs’ Mob might find other countries will follow Italy’s lead. A European Commission is carrying out an investigation into the tax arrangements of numerous multinational companies accused of using cross-border structures to reduce their tax bills, sometimes with the help of secret and potentially illegal "sweetheart" deals.
    Apple's activities in the Republic of Ireland are currently subject to that investigation, which is due to announce soon whether tax breaks designed to secure the company's extensive investment in Ireland amounted to illegal state aid.
    The company's chief executive, Tim Cook, has rejected accusations that the firm has been sidestepping US taxes by stashing cash overseas, insisting: "We pay every tax dollar we owe."
    Of course in his head Apple only owes tax when it thinks it owes tax, which is hardly ever.
    On a visit to Ireland in November that he was confident the Dublin government and his company would be found to have done nothing wrong. Although in Rome the Apple stores are known by the name iCON which should sort of give the game awy a bit.

    Apple Closing a $12.8 Billion Deal with LG and Samsung for OLED Panels

    We saw rumors earlier this month claiming that Apple will be switching from LCD to OLED displays for future iPhone models, starting from 2018. Things seem to be gaining pace now as a latest report suggests Apple is finalizing its deal with LG Display and Samsung.

    Apple sourcing iPhone OLED panels from LG and Samsung:

    Apple’s plans to switch from IPS LCD to OLED have been around for years now. According to ETNews, Apple is close to entering into an agreement with Samsung and LG as its suppliers for flexible OLED panels for the iPhones. The tech giant is reportedly spending over $12.8 billion in the combined deal.
    LG and Samsung Display are close to a final agreement with Apple for the screens, the Electronic Times report said, adding the two Korean firms plan a combined 15 trillion won ($12.8 billion) in capital expenditure to build up OLED production capacity over the next two to three years. – Reuters.

    Earlier rumors of Apple planning to use OLED screens for iPhones starting in 2018 seem to fit well with these latest claims as both these suppliers have to start ramping up their production capacities. LG is said to be switching its existing LCD lines to manufacture OLED panels to reduce investment costs, while negotiations with Samsung are still ongoing as Samsung is likely getting a bigger slice of this deal. Apple is also providing funds for some of the equipment that LG and Samsung Display will require to increase their production capacity.
    While Apple’s iPhones feature top of the line hardware, including industry leading chips, it has a long way to go in terms of screen quality to please its user base. OLED displays aren’t only thinner, but are also said to be more power-efficient. However, users have long wished for these panels as they offer more vivid colors. For Apple’s side of the story, these panels can be expensive than the LCD screens and they are also said to be more prone to breakage.
    One thing is certain that iPhone 7 expected in September 2016 is not going to feature an OLED display. Apple might be able to fit an OLED panel inside iPhones starting from 2017 or 2018 but it’s not expected to arrive in next year’s iPhone models.

    Fruity cargo cult Apple is actually peddling software which is even less secure than Adobe Flash Player, according to new statistics.

    This is jolly ironic because Steve Jobs banned the Adobe Flash from his fruity machines because he claimed it was too buggy and got his software into trouble. Now it seems that the iOS and Mac OS X is so buggy that Adobe might be making similar complains.
    Every year, Common Vulnerabilities and Exposures or CVE, collects information about software vulnerabilities across major forms of various software, and for the year of 2015 Apple topped that list with its Mac OS X accounting for 384 security flaws and its iPhone OS accounting for 375 security flaws. Adobe Flash Player came in third with 314 security flaws, 61 less than Apple’s iOS.
    The figures dispel the myth that Windows and Android software is buggier than Apple’s. Microsoft’s out-of-date explorer does rank at number seven, but none of its operating systems appear in the top ten. Android makes an appearance at 20.
    Microsoft’s Windows 8.1 makes the list at #12 with 151 security flaws, and the newly introduced Windows 10 is all the way down at #36 with 53 security bugs, though it was introduced in the latter half of the year after being available as a beta.
    The list is controversial because it shows applications alongside operating systems and separates out the versions of Windows unlike Apple’s desktop and mobile OSs. Either way it shows that software standards at Jobs’ Mob are falling.

    Apple shares continue to tank



    Fears of iPhone and China dependence
    Wall Street’s love affair with the fruity cargo cult is definitely slipping as the cocaine nose jobs wake up to the fact that the company is unlikely to hold its historically high earnings.

    Shares of Apple have fallen to their lowest since August on Monday following recent fears that no one is buying the newish iPhone and indications that Chinese sales were also going to slump.
    After its iWatch failed to take off, Jobs’ Mob has been out of ideas and with no new products in the offing has been forced to lean on China sales and the iPhone to keep its record sales figures. With the bottom cut out of these, Apple is looking vulnerable.
    At one point Apple was down 3 percent and weighed more than any other stock on US. The Tame Apple Press is doing its best to claim that there is nothing to worry about. Reuters pointed out that Apple’s rival Samsung is also predicting a pants 2016. However Samsung has other products to fall back on, where as Apple is dependent on just one.
    Jobs’ Mob is expected to try and resolve its woes in the short term by issuing the new iPhone early. It already inflated the sales for its iPhone 6S by starting sales in China at the same time as the US rather than delaying them until the next quarter.
    However it can only do that so much and Wall Street is clearly wise to it. Shares of Apple are down about 23 percent from April. The belief is that things will be tight next year and fewer will replace their smartphones.
    Everyone knows now that Wall Street’s iPhone 6S estimates were too high and a third of analysts tracked by Thomson Reuters have trimmed their estimates for Apple.
    For fiscal 2016, Apple is now expected, on average, to grow revenue by under 4 percent, a far cry from the 28 percent revenue expansion it achieved in the fiscal year that ended last September.

    Apple kills iPhone headphone socket



    New cables for iPhone

    It has been confirmed that Apple is going to force its beleaguered users to ditch their headphones in favour of more expensive wireless or Lightning sets.

    The fruity cargo cult has decided that the only way to get its iPhone’s thinner is to ditch the headphone socket.
    The confirmation does not come from Apple of course, but the outfit’s supply chain. But it backs up what we had already heard.
    As far as Apple is concerned it means that users will have to scrap their old headphones when they buy the new iPhone. This means that they will also lose connectivity with shedloads of accessories like aux in to speakers, camera releases, headphones and flash units.
    Of course the Tame Apple Press is telling the world that it is not so important that they can actually use their phones, it is more important to move on to a standard that no one else is using and waste money on gear that can’t be used elsewhere.
    Lightning is supposed to support higher quality audio, but given that the original would have been compressed to hell and played using an Apple digital to analogue decoder we doubt anyone would be able to tell the difference. There are some on the market now, but not that many. Nine to five Mac thinks that most Apple sets will be wireless, so I must get my paws on a wi-fi jammer.

    Samsung asks court to see common sense over Apple patents

    Samsung has urged a US appeals court on Tuesday to find that a jury in 2014 should not have made the South Korean company pay nearly $120 million to Apple for infringing three patents – The three slide-to-unlock, autocorrect and quick links features.

    The biggest row was over Apple's "quick links" patent, which accounts for more than $98 million of the damages award.
    Samsung's attorney Kathleen Sullivan told the court Samsung did not use the same technology as Apple to detect and link to specific data, such as phone numbers, in its phones' Web browser and messenger applications.
    Apple's lawyer, William Lee, told the U.S. Court of that the jury's verdict was supported by "substantial evidence."
    However two of the three judges at the hearing seemed to question Apple's arguments over the interpretation of the patent, which Sullivan said the appeals court had already rejected in a separate case. Lee cautioned against accepting Samsung's theory, which was rejected by the jury which believed everything the American company said.
    Samsung also said the two other patents it was found to have infringed are invalid, an argument Apple said should be rejected.
    The same appeals court in September ruled that Apple should have been awarded an injunction in the case, barring Samsung from selling devices that infringe its patents. The court, however, said Samsung could remove the patented features without recalling its products.
    Samsung has already paid Apple $548.2 million, part of what it owes for infringing different patents and designs of the iPhone. Samsung is continuing to fight that case by appealing part of the judgment to the US Supreme Court. Another trial on further damages will be held in March.

    Companies suffer as Apple slashes production



    Apple bubble bursting

    The industry leaders who depended on Apple to continue making shedloads of money peddling similar products each year are suffering as Apple slashes production as people no longer want their main product – the iPhone 6s.

    Apple told its suppliers to slash the numbers of iPhone6Ss by a third because they were sitting gathering dust in fruity cathedrals of worship, or Apple stores as they are known by the faithful. Now the fall out is spreeding to the rest of the industry.
    Not to Foxconn, at least not for now, because it just picked up a grant from the Chinese government which is a little worried that it might be forced to lay off all its workers now they have not got anything iPhoney to assemble.
    Shares in Apple itself fell 2.5 per cent Arm is 3 per cent , Imagination Technologies and Laird have taken a minor hit. Elsewhere Dialog Semiconductor is down 4.2 per cent and ASML has fallen 2.5 per cent.
    Beancounters at Liberum have warned that Apple had initially told suppliers to keep production flat with last year’s levels and this cut would be negative for a number of companies in the semiconductor sector.
    @In Europe Imagination, Laird, ASML and ARM have significant exposure to Apple and its supply chain. Imagination derives about 34 per cent of its revenues from Apple, ARM close to 10 per cent and Laird about 20 per cent. ASML gets about 25 per cent -30 per cent of its revenues from foundries which are mainly spending on capex to cater to Apple’s demand. DRAM (50% of ASML’s revenue) is also partially Apple dependant. We remain cautious on all these stocks and see the risks being to the downside," Liberum warned
    A lot of companies which smuggly fiddled while other companies suffered from the downturn of hte smartphone industry believing they were safe because of their Apple contract are expected take a signficant hit. Many of them were expanding because they believed, against all evidence that Apple would continue to sell the iPhone when no one was actually buying them. The fact it managed it a bit longer was more of a triumph of marketing and now it looks like the Apple bubble is about to burst.

    Apple Shares Drop Below $100 For First Time Since August

    Apple Acquires ‘Emotient’ Emotion Detection Technology

    As reported by the Wall Street Journal, Apple has acquired an artificial intelligence startup, Emotient. Emotient’s cloud based technology makes use of artificial intelligence to sense emotions by analyzing facial expressions of an individual. Emotient’s website is still live followed by the acquisition that describes the technology as ‘the leader in emotion detection and sentiment analysis based on facial expressions. The company is at the vanguard of a new wave of emotion analysis that will lead to a quantum leap in customer understanding and emotion-aware computing.’

    Emotient Has Been officially Acquired By Apple

    The application of this technology is to measure customers unedited emotional reaction to ads, products and services, content or sales interactions. There might be various reasons for Apple to acquire the emotion detection technology, but what we can never be sure of. Moreover, Apple’s motives could also be classified as acquiring talent. The financial terms of the agreement were not disclosed along with the reasons to acquire Emotient.
    An Apple spokeswoman confirmed the purchase with the company’s standard statement after an acquisition, saying Apple “buys smaller technology companies from time to time, and we generally do not discuss our purpose or plans.” She declined to elaborate on the deal terms.
    Previously, the company’s technology was being used by various advertisers to judge the quality and effectiveness of specific ads. The technology used by Emotient indicates via emotional reactions irrespective of the ad reactions being positive or negative. It is basically based on how viewers were watching the advertisement. According to the company’s LinkedIn profile, “Emotient’s flagship service, Emotient Analytics, analyzes videos of customers as they experience marketing, products and services,”

    Emotient’s technology has the capability to detect facial expressions of hundreds of people at once in real world situations. This might mark an important feature as it can analyze emotions in an unfiltered manner for crowds. By processing facial feedback, the tech measures an overall emotion that can range from being positive, negative, sadness, disgust, fear, anger, surprise, contempt and other advanced emotions like confusion and frustration. Moreover, in September of the previous year, the company was issued a patent to make emotion detection anonymous and another patent to automate facial expressions analytics.

    Apple has a running list of acquired artificial intelligence companies and today’s buy adds to it. Apple bought Perceptio last October followed by another purchase of VocalIQ. It might be that Apple will one day make use of these takeovers and provide artificial services to customers, whether incorporated in its products or separately.

    Beancounters at Digitimes Research have been adding up the numbers and dividing by their shoe size and have calculated that iPhone shipments are likely to drop 5.2-10.1 per cent on year in the first quarter of 2016 as sales of iPhone 6s and 6s Plus both performed weaker than expected.
    The decline rate of iPhone sales in the first quarter of 2016 will be significantly lower than orders to OEM iPhone makers and component suppliers for the quarter, Digitimes Research warned.
    The Tame Apple Press has tended to focus on the annual growth rate of over 50% from the fourth quarter of 2014 to the second quarter of 2015 after Apple launched its iPhone 6/6 Plus in late September 2014.
    But on-year growth slowed to 36 per cent in the third quarter of 2015, sales of iPhone products accounted for over 60 per cent of Apple's total revenues for four consecutive quarters through the quarter.
    Digitimes Research thinks the reason for the slowdown was the fact that the iPhone 6 had a bigger screen which attracted high interest among consumers. This boosted the sales figures. However the iPhone 6s had nothing new or compelling so users gave it a miss.
    Combined iPhone shipments for the fourth quarter of 2015 and the first quarter of 2016 are likely to lie within a range of 5 per cent up or down as compared to combined shipments the same period of a year earlier, Digitimes Research estimated.
    But Digitimes Research found that there was a significant gap between the production volume of iPhone 6s/6s Plus by OEM suppliers and the sales volume of these devices by Apple for the third quarter of 2015 (Apple's fiscal fourth quarter of 2015).
    This means that 13-15 million iPhone 6s devices will be booked as deferred sales by Apple for the fourth quarter of 2015 (Apple's fiscal first-quarter 2016).
    Digitimes Research thinks that deferred sales booking will continue in the first quarter of 2016, widening the gap between end-market sales and orders to OEM suppliers for the quarter.
    Shares in Apple are dropping below $100 for the first time as the downturn in the smartphone market catches up with Jobs’ Mob. While its rival Samsung has suffered from the same problems, the company has more products and is less dependent on one or two like Jobs’ Mob.

    Apparently it was worth denying

    The Apple Press office works in the same way as the British Royal Family’s. Its official line on most things is “no comment.” But this week it took the rare position of denying a rumour.

    The rumour was that Apple was being forced to see off an anti-trust action by the EU, or wanted to butter up the telcos, by offering a package to upgrade its users from i0S to Android.
    The rumour was so stupid we did not bother with looking at the story. Apple would rather pull out of the European market than contaminate its iPhone with Android. Besides there would be no way to tell an iPhone from any other smartphone in the market. Apple would never butter up its telco partners as it sees them as lucky that they are allowed to sell its products for them.
    However Apple decided to actually offer a flat-out denial.
    Apple spokesperson Trudy Muller said: "There is no truth to this rumor. We are entirely focused on switching users from Android to iPhone, and that is going great."
    What she was mentioning was the move to iOS app, which lets Android device owners easily move content over to an iPhone or iPad.
    The source of the rumour was the UK’s Daily Telegraph which is not legendary for making stuff up. It is possible that Apple is just delaying the inevitable but in this case it is extremely unlikely and the flat denial confirms it.

    Apple Might Have To Decrypt Its Smartphones – Latest New York Bill Demands It

    Apple, along with other manufacturers might have to pay a significant penalty if they do not comply with the latest New York bill, which states that smartphone manufacturers will have to decrypt and unlock devices for security purposes.

    Apple And Other Manufacturers Will Be Fined $2,500 Per Device If They Do Not Comply, Assuming The Bill Gets Voted Up

    According to the information present on Macrumors, the New York state assembly is currently in the process in rolling out the final draft of a bill that will require smartphone manufacturers like Apple and several others to decrypt and unlock devices in order to provide aid to law enforcement personnel. According to the bill details, any manufacturer or OS provider not complying with the requirements of the bill will have to pay a fine of $2,500 per device, and we know how that is not going to work out well for Apple, despite the fact that it has a market cap of $550 billion USD.
    After January 1, 2016, any smartphone being sold in New York not following the requirements will definitely be facing the wrath of the law. Assemblyman Matthew Titone introduced the bill last summer and he has justified the decryption process of smartphones, stating that the law enforcement will be able to work more effectively if a backdoor is provided. He states the following:
    “The safety of the citizenry calls for a legislative solution, and a solution is easily at hand. Enacting this bill would penalize those who would sell smart- phones that are beyond the reach of law enforcement. The fact is that, although the new software may enhance privacy for some users, it severely hampers law enforcement’s ability to aid victims.

    Time and time again, Apple and Tim Cook have spoken against this bill, because of a very good reason. If smartphones and other mobile devices are decrypted, they might provide uninterrupted access to those looking to preserve security, but it will also grant several opportune moments to hackers, who can then effortlessly steal sensitive information present on these mobile devices. The bill currently has to be voted up by the assembly and the state and if majority of them do not approve of the bill, then Apple, and several other smartphone OEMs will be keeping a tight lid on their security.

    Analyst calls for “Clueless Cook” to be replaced



    Apple is doomed if it doesn’t

    Trip Chowdhry of Global Equities Research has called for the “completely clueless” Apple CEO Tim Cook, to be replaced.

    We don’t know if Chowdhry reads Fudzilla but he appears to at the very least agree that Apple is doomed and he is blaming the man who Apple Messiah Steve Jobs handed the company over to – Tim Cook.
    Apple’s shares fell hard in the second half of 2015, and is now down more than 25 per cent from its July high and it looks like things are going to get much worse as Apples only significant product, the iPhone slumps.
    But what is worrying Wall Street is that no-one in Apple appears to care. Its management appears to believe its own marketing and thinks it is an innovative company which invents new products that everyone buys. To be fair it never was, but at least its marketing could convince enough of the world that this was the case.
    Wall Street sentiment has started to shift for Apple, and the shares are dangerously close to a new 52-week low after falling below $100 for the first time since August. Apple’s stock is actually at its lowest level since October 2015.
    With the iPhone 6s failing and the iPhone 7 not around until the second half of the year, Jobs Mob really has nothing. The new iWatch, which is basically what the old iWatch should have been, is unlikely to sell well. Apple made a huge mistake of issuing product which was out-of-date when it arrived and with none of the health features which would have made users go “wow.” It sold few of the devices and many users questioned if they would buy another.
    New services like Apple Pay and Apple Music have also not gained the expected traction thanks to the fact that there is a lot of better competition out there.
    In fiscal 2015, which ended in October, Apple recorded $234 billion in total net sales. Of that figure, the iPhone tallied $155 billion, or 66 per cent. The next biggest category, the Mac computer segment, accounted for less than 10% of sales.

    What’s more, the iPhone’s share of Apple’s revenue has only grown. In 2014, the smartphone was worth 56 per cent of sales and in 2013 just 53 per cent. That means the iPhone is more important than ever before.
    So a huge cut in iPhone production means the beginning of Apple doom and this really is all Tim Cook’s fault, at least according to Chowdhry.
    To be fair to Cook, Chowdhry is not the best commentator on things Applish. In the past he made a couple of silly comments about how Apple would only be saved if it put out an iWatch. Cook himself cannot he held entirely responsible either. He inherited a company which was built around taking something that had been widely rejected, marketing the hell out of it and convincing people they really wanted it. It worked when you had an archetypal snake oil salesman like Steve Jobs. But also Jobs had it easy. There were some interesting products to choose from.
    To save itself Apple needs to spend a lot of its cash pile researching real innovations and getting them to market. Its managers need to lose their smugness and behave like a real company rather than a self-obsessed cult.
    I have no doubt that they will fail to do this completely, simply because the reality distortion field around Apple will continue to tell it that it is “super, cool, and innovative” long after they have had to sell their Spaceship HQ to keep afloat. Hell, if we could see this two or three years ago we can't understand why Cook and his chronies couldn't.
