    Apple Faces Class Action Lawsuit For 'Disappearing' Storage Space In iOS 8

    A class action lawsuit filed this week in the Bay Area's federal court is taking Apple to task over claims that iOS 8 can chew up as much as 23.1 percent of the advertised storage space on the company's mobile products. In reality, there's no way to avoid using up a certain amount of space on electronic devices that require a meaty operating system, though in this instance, the lawsuit alleges that Apple doesn't inform potential buyers how much of their device's advertised capacity goes to the OS.

    To make matters worse, the lawsuit says Apple encourages users to purchase more storage space through its iCloud service. The suit seeks unspecified damages along with changes to Apple policies under California state law, according to SiliconBeat.


    "We feel that there are a substantial number of Apple consumers that have been shortchanged, and we'll be pursuing the claims vigorously," said William Anderson, a lawyer at Cuneo Gilbert & Laduca, a law firm based in Washington, D.C.

    The lawsuit points out that customers who install iOS 8 or purchase a device with iOS 8 already installed allegedly receive a lot less storage than advertised, which can range from 18.1 percent of the iPhone 5s to 23.1 percent for the iPod.

    "Using these sharp business tactics, defendant gives less storage capacity than advertised, only to offer to sell that capacity in a desperate moment, e.g., when a consumer is trying to record or take photos at a child or grandchild’s recital, basketball game or wedding," the lawsuit reads.

    Apple touts iOS 8 as being its biggest release since the App Store. It represents a major overhaul to the mobile platform with loads of new features from top to bottom. Devices that support iOS 8 include iPhone models from the 4s to the 6 Plus, all three iPad mini tablets, the 4th generation iPad on up to the iPad Air 2, and the 5th generation iPod touch.

    Intel could save Apple’s bacon



    FinFET is half baked

    The fruity cargo cult Apple is apparently having problems getting its partners to make 3-D transistors that go.



    Drexel Hamilton’s chip analyst Rick Whittington [no really] made a comment that Intel might be getting ready to bail Apple out while he was having a chat about Micron. In passing, Whittington noted problems had by Taiwan Semiconductor and Samsung Electronics trying to produce 3-D transistors in any useful yield.
    He noted that Intel has mastered 3-D transistors, and said that it would be very good for Intel if neither Samsung or TSM can do FinFET this next year; puts them in line to supply Apple’s internal foundry needs.
    However he admitted that it was more that TSM/Samsung would operate FinFET under very low yield output and keep capacity tight.
    Of course if Jobs’ Mob don’t want that they can always rush into the loving arms of Chipzilla – again. As happened with Saphire glass Apple has shown that it can dump a partner quickly if it does not move fast enough.

    Apple Accounts for 51% of Devices as Christmas Gifts

    When you think of only one company being responsible for over half of the electronic devices sold this holiday season, it’s really hard to believe. Apple pulled off this feat and just possibly pointed out the trends for the rest of 2015 in the process.


    If Christmas is a bellwether for the year ahead, users should expect strong performance from iOS devices and a continued shift to the once-derided phablet form factor.

    U2's Bono applauds Apple and Spotify for digital music payments

    U2 front man Bono is appreciative to see Apple and Spotify stepping up to pay musicians during a turbulent time in music. Digital album and song downloads are sliding, as more listeners turn to streaming music services, and some artists aren't supportive of the current trend.


    Bono said Apple is "unique in big tech in trying to get artists paid," at a time when iTunes, Spotify, and other services garner various acceptance from musicians and the music industry.

    "We all now understand the Internet is giving us access to information that is mostly flattening an uneven playing field," Bono recently said. "This is all good except when some technologists think that creative content is only valuable in its ability to show off their wares - hard or soft."

    The music industry will continue its efforts to try to adapt to a steady migration from paid and illegal downloads to online streaming services.

    Qualidade do software da Apple está a "cair a pique"

    De facto tenho notado que a qualidade não tem sido a mesma de antigamente, é bugs, erros, problemas, a aparecerem com muito mais frequência do que era normal na marca. Esta ânsia de apresentar novidades ao povo cada vez mais cedo, tem os seus custos.

    E Já diz o ditado, que depressa e bem não há quem. Quanto mais encurtarem os ciclos, maior a probabilidade de erros e problemas, o produto não chega a amadurecer convenientemente.

    Falando do OS X, continuo a usar o Yosemite, mas de facto ele por vezes tem pancas, o Mavericks era/é mais sólido de uma forma geral.

    Monster sues Beats for ‘deceit’ pre Apple deal

    Monster, the company perhaps most well-known for trying to convince the world that they need to spend £80 on a HDMI cable, is suing Beats, the recently purchased subsidiary of Apple and owner of the Beats by Dre headphone line, over “fraud and deceit,” with how it attained controlling rights over the brand. Monster was instrumental in the development of the popular headphones, but claims that it was cut out of the company by a 2011 deal with HTC, meaning that it missed out on millions when the company was eventually sold to Apple last year.
    The suit, detailed by Reuters, claims that the deal with HTC, which saw the Taiwanese smartphone maker purchase a controlling stake in Beats for $309 million, was deliberately designed to remove Monster’s stake from the business. Monster’s relationship with Beats ended shortly after, even though Beats almost immediately bought back a large share of HTC’s stake in the firm.

    It’s not known whether Noel Lee, founder of the company, can turn into an actual monster.
    It claims that both hip-hop artist producer Dr Dre and co-founder of Interscope records and Beats, Jimmy Iovine, “improperly erased” Monster’s influence on the creation of Beats products, specifically the headphones which have become somewhat of a fashion statement in recent years. With Apple then spending several billion on acquiring the brand and its associated products, Monster is now claiming general damages, as well as special and punitive damages from Beats, HTC and both Dre and Iovine.
    While everything that Monster claims happened, may have taken place, the fact that it waited until several years afterwards to file a complaint like this is a little suspect. It may also find it difficult to prove that there was any plan to cut the company out of a deal with Apple, when that didn’t take place until three years after Monster’s stake in the Beats brand came to an end.

    EFF claims Apple developer agreement blocks freedom



    More oppressive than Saudi

    Apple's autocratic Dev Agreement means that the Electronic Foundation Frontier can't put out an iPhone version of its App.


    This week the EFF launched a new app that will make it easier for people to take action on digital rights issues using their phone. The app allows folks to connect to its action centre quickly and easily, using a variety of mobile devices. However, the EFF said it could not release its app on the iPhone because it could not agree to the "outrageous terms" in Apple's Developer Agreement and Apple's DRM requirements.
    What got the EFF's goat was the following clauses in the agreement:

    Ban on Public Statements: Section 10.4 prohibits developers from making any "public statements" about the terms of the Agreement. This is particularly strange, since the Agreement itself is not "Apple Confidential Information" as defined in Section 10.1. So the terms are not confidential, but developers are contractually forbidden from speaking "publicly" about them.
    Ban on Reverse Engineering: Section 2.6 prohibits any reverse engineering (including the kinds of reverse engineering for interoperability that courts have recognised as a fair use under copyright law), as well as anything that would "enable others" to reverse engineer, the software development kit (SDK) or iPhone OS.
    App Store Only: Section 7.3 makes it clear that any applications developed using Apple's SDK may only be publicly distributed through the App Store, and that Apple can reject an app for any reason, even if it meets all the formal requirements disclosed by Apple. So if you use the SDK and your app is rejected by Apple, you're prohibited from distributing it through competing app stores like Cydia.

    No Tinkering with Any Apple Products: Section 3.2(e) is the "ban on jailbreaking" provision that appears to prohibit developers from tinkering with any Apple software or technology, not just the iPhone, or "enabling others to do so."
    Apple Owns Your Security: Section 6.1 explains that Apple has to approve any bug fixes or security releases. If Apple does not approve such updates very quickly, this requirement could put many people in jeopardy.
    Kill Your App Any Time: Section 8 makes it clear that Apple can "revoke the digital certificate of any of Your Applications at any time." Steve Jobs once confirmed that Apple can remotely disable apps, even after they have been installed by users. This contract provision would appear to allow that.
    "Lots of developers hold their nose and sign the agreement despite these onerous conditions, and that's understandable. The Apple App store is a huge market and hard to ignore if you want your business to succeed. And sometimes, developers have to weigh these onerous restrictions against not just their ability to survive financially, but also their ability to reach and protect users from snooping and censorship," the EFF said.
    The EFF said it was proud of the tool it had developed and think it offers a great new way for people to speak up and take action. It wanted to be available and used by as many people as possible, including iPhone users. That is impossible.
    The last straw was when the EFF was told it had to include a form of Digital Rights Management (DRM). "When we create tools for EFF, we want them to be broadly available to others to use, adapt, and customise. That's why we work to make our technical projects based on free software, and avoid DRM," the EFF said.
    Of course it does not really matter. Apple users are not fond of freedom anyway.

    Apple jacks up its prices for foreigners



    Pay for your American overlords' habit

    Fruity cargo cult Apple has decided that Apple fanboys across the EU will have to subsidise their American brethren and pay even more for their Apps.


    Jobs' Mob has been worried for a while now that it will lose ground in the US against Android if it gets too expensive, but at the same time has to continue its policy of charging more for less. The answer is to increase prices all over the world other than the US.
    In a memo to software developers on Thursday morning, informing them that the firm will be jacking up App Store prices outside the US (with a few exceptions) by the end of the week.
    "Within the next 36 hours, prices on the App Store will increase for all territories in the European Union as well as in Canada and Norway, decrease in Iceland, and change in Russia," the memo said.
    Apple claims that the changes are being made to take into account adjustments in VAT and foreign exchange rates, but since Apple did not reduce its prices when the currency rates were favourable and there has been no change to VAT since 4 January 2011, it should be seen for what it really is.
    Apple claims this is down to the higher cost of doing business overseas but given that it does not pay much tax on its foreign business that also should be seen for what it is.
    What it means is that Apple fanboys in the US will get what they pay for, while the rest of the world has the honour of helping them.

    Apple raises minimum price of paid apps in App Store

    Apple has had to go ahead and raise the minimum price of paid for apps available on the UK iOS App Store. From this morning onward, apps that used to cost 69p will now cost 79p instead in order to bring prices in line with VAT and exchange rates.
    The company explained in a statement last night that: “Prices on the App Store will increase for all territories in the European Union as well as in Canada and Norway, decrease in Iceland, and change in Russia. These changes are being made to account for adjustments in value-added tax (VAT) rates and foreign exchange rates.”

    This comes down to a recent EU policy change, which now requires Apple to deduct VAT based on the location of its customers, rather than the location of the company itself. Apple’s EU operations are ran out of Luxembourg, where tax rates are fairly low- which has led to a small price bump in the UK.
    So those of you that actually buy apps will have to get used to paying a little bit extra on iOS.

    Eight days into 2015 and Apple’s App store is breaking records

    Apparently the new year is a good time to be an app developer for the Apple ecosystem. Apple annoucned today, that the first week of 2015 has set new records in the App Store, with customers around the world spending nearly half a billion dollars on apps and in-app purchases. New years day itself was the biggest single day ever in App Store sales history.
    In a press release today, Eddy Cue, Apple’s senior vice president of Internet Software and Services said: “This year is off to a tremendous start after a record-breaking year for the App Store and our developer community, we’re so proud of the creativity and innovation developers bring to the apps they create for iOS users and that the developer community has now earned over $25 billion.” Of this $25 billion at least $10 billion was earned in just the last year, indicating that developer revenue is growing massively as well.

    The App Store now contains 1.4 million apps for iPhone, iPad and iPod and with iOS 8 and more payment methods, including Apple Pay, recently being rolled out in several different countries, the reasons for the record breaking success become clear. Apple Pay in particular, seems to be doing very well as an App Store payment method with over 90% of of credit card purchases in the US now using Apple Pay. Apple also disclosed that with the help of it’s customers, it has now donated $20 million this quarter, and over $100 million in total to the (RED) Global Fund to fight AIDS.

    Apple has also sent out the email above to App Store developers to inform them of pricing changes, that will soon be applied across large parts of the world, something that it left out of their press release. The price rises in the EU are expected, with the new VAT laws that have already come into effect from the 1st of January, all providers of electronic services (software downloads, cloud business, online gaming, certain e-learning, online payment services, etc.) must charge VAT based on the customer country of residence, rather than a flat rate across the whole of the EU.

    8 Years Ago On This Day, Apple Announced The Original iPhone

    It seems hard to believe that it’s been eight years since the original iPhone was first announced. At the time many of us were using smartphones like the Samsung Blackjack, and if you were a true diehard, BlackBerry smartphones. And for those of us that didn’t have smartphones, there were still plenty of bar- and flip-phones out there to choose from.

    But Apple swooped in with its highly anticipated iPhone on January 9, 2007 at MacWorld 2007, right smack dab in the middle of CES 2007. Then Apple CEO Steve Jobs wanted to steel the thunder from the show that was taking place in Las Vegas, and he definitely got his wish.



    Just before Jobs revealed the iPhone, he remarked how Apple had created a "widescreen iPod with touch controls”, a "revolutionary mobile phone”, and a "breakthrough Internet communication device.” What Jobs unveiled was the iPhone, which did away with the hardware QWERTY keyboard in favor a 3.5” touch screen with multi-touch support. Jobs introduced us to such terms as “pinch to zoom” and “visual voicemail” and declared that the touch screen would make physical keyboards on smartphones obsolete (he would largely be proven correct).

    The iPhone managed to include an easy to use Safari Internet browser, email support, vastly improved access to media content, and innovative ways to interact with images. It’s hard to imagine it now, but the first generation iPhone was powered by a 412MHz ARM processor (complete with 128MB RAM), featured a large [at the time] 3.5” 480x320 display, and was initially only available in 4GB or 8GB capacities. Notable downsides to the device included its lack of 3G connectivity (it only supported Edge) and the fact that the 4GB and 8GB iPhones cost $499 and $599 respectively with a new 2-year contract on AT&T.

    The iPhone arguably kicked off the smartphone arms race that now has turned into “Google Android versus everyone else” in worldwide sales. Companies that were at the forefront of smartphone innovation when the iPhone first hit the market — namely BlackBerry and Microsoft — find themselves fighting for table scraps in today’s smartphone market.

    Who knows what the smartphone market will look like in the next 8 years, but for now, we can at least look back and witness a pivotal moment in the history of smartphones:

    Apple toots its own horn, indirectly helped create 1 million jobs

    Apple added 9,000 new jobs in 2014 alone, but says it has directly and indirectly led to more than 1 million jobs being "created or supported" by the company. In addition to its Apple headquarters and stores throughout the country, Apple also has generated great interest among app developers within the community.


    "This year is off to a tremendous start after a record-breaking year for the App Store and our developer community," said Eddy Cue, senior VP of Internet software and services at Apple.     Apple’s New Store Displays Are Weird


    Apple has always had some pretty odd store displays. From floating MacBooks to giant iPhones, you’d think they couldn’t get anymore strange.
    The video bellow was taken at Apple’s Regent Street store in London, and shows iPad Smart Covers opening all by themselves. Looking at the video, it’s easy to be puzzled as to how they’re doing this. Wires? Air? Tiny motors?
    If you’re not familiar with the Smart Cover, they’re Apple’s clever solution to protecting iPad displays from scratches and other damage. They utilise magnets to stick to the display and form other shapes to allow the iPad to stand in different positions. The magnets also act as a way of switching the iPad display on and off, as can be seen in the video.

    Apps in Apple's App Store have made over $10 billion this year

    We know that the App Store has some serious numbers, but what about the actual revenue that apps make on Apple's digital storefront? Well, the company has said that developers have earned over $10 billion across 2014.


    Close to half a billion dollars was spent on apps and in-app purchases in the first week of January 2015 alone. This number balloons out to a huge $25 billion since the App Store opened its digital doors back in 2008. This makes the numbers from 2014 even more impressive, as they represent around 40% of the total revenue of the App Store, even considering it's been operating for six years.

    Apple Patent Hints at Motion Control for Macs, Apple TV


    Like a Jedi reaching out to magically control objects, you may be able to swipe your hand to control your Apple device soon. Apple has obtained a patent for "three dimensional user interface session control," or the use of 3D gestures to control on-screen activities.
    The US Patent No. 8933876 details Apple's plans for creating a user interface controlled by hand and arm gestures via PrimeSense's motion-sensing hardware. A 3D camera is used to track the user's movements, which are them translated into digital commands that control on-screen actions. Some of the gestures include push and wave motions that can do things like minimize windows on the screen.

    The patent shows that the gesture controls can be turned on and off depending on the current mode of the user interface. This would allow users to save battery life and avoid unwanted actions caused by random movements.
    The diagrams show the technology used with a desktop computer, but it could also be used with Apple TV or with iOS devices. This technology seems similar to the Leap Motion device, Xbox Kinect and Intel's RealSense 3D camera. However, most of the current talk around RealSense is its use in gaming and scanning real-life objects for 3D printing.
    Apple seems to want to use 3D gestures more universally, as a way to control complete user interfaces. The company's acquisition of PrimeSense and all its patents last year will certainly make it easier to follow through on this patent.
